Two charged with murder in killings of Louisiana cops

NEW ORLEANS (Reuters) - Louisiana state police brought first-degree murder charges on Wednesday against two men being held in connection with a pair of shootings near New Orleans in which two police officers were killed, authorities said.

The new charges mean 24-year-old Brian Lyn Smith and 28-year-old Kyle David Joekel could face the death penalty if convicted of killing deputies Brandon Nielsen, 34, and Jeremy Triche, 27.

The officers were investigating the shooting and wounding of deputy Michael Scott Boyington, 33, at around 5 a.m. on August 16 in a Valero Energy Corp refinery parking lot during a shift change. The shooter fled.

While investigating the shooting in LaPlace, about 25 miles west of New Orleans, Nielsen and Triche ended up at a trailer park. St. John Parish Sheriff Mike Tregre said that as they were interviewing two suspects, a third person came from a trailer and fatally shot the two officers and wounded deputy Jason Triche, 30.

Smith and Joekel were among seven people charged last Friday in connection with the parking lot shooting.

St. John Parish District Attorney Thomas Dailey said in a statement on Thursday that his office would present the new charges against Smith and Joekel to the grand jury. The next regularly scheduled session of the grand jury is September 4.

The charge of murdering a police officer in the performance of duty automatically carries the death penalty under Louisiana law, according to New Orleans criminal defense lawyer Lindsay Larson. Capital cases must go before a grand jury.

The seven people suspected of being involved in the shootings are in custody at the St. Charles Parish Correctional Center. They include Terry Smith, 44, Derrick Smith, 22, Chanel Skains, 37, Brittney Keith, 23, and Teniecha Bright, 21, who face charges as principals or accessories to murder or attempted murder.

Authorities said Joekel was wanted in Kansas and Nebraska in connection with threats against law enforcement officers.

Tropical Storm Isaac threatens Caribbean, Republican Convention

MIAMI (Reuters) - Tropical Storm Isaac swirled over the Caribbean on Wednesday and was forecast to become a hurricane as it moved on a track that would put it off the coast of Florida on Monday, the opening day of the Republican National Convention in Tampa.

The threat to the Caribbean was certain, with Isaac already closing in on the Leeward Islands and hurricane watches in effect for many places, including Puerto Rico and the U.S. and British Virgin Islands.

Isaac could also potentially threaten U.S. energy interests in the Gulf of Mexico, weather experts said. It was centered about 210 miles east of Guadeloupe early on Wednesday, the U.S. National Hurricane Center (NHC) said.

Isaac had top sustained winds of 45 miles per hour and was forecast to become a hurricane by Friday, as it neared the coast of Hispaniola, the island shared by the Dominican Republic and flood-prone Haiti. Computer forecast models showed the storm moving west-northwest across the island on Friday.

Tampa Mayor Bob Buckhorn, a Democrat, said he wasn't really worried about Isaac, however.

"We're watching it. We're tracking it. I think we're going to be OK but we'll be prepared in the event it heads this way," Buckhorn told CNN.

"We hope it moves further away from us, but if it doesn't it's still going to be a great convention and I think the Republican National Committee is going to be happy," he said.

Florida has not been hit by a major hurricane since 2005 and no one is forecasting that Isaac will strengthen into anything more than a weak Category 1, with top sustained wind speeds of about 80 miles an hour.

Still, the threat to Florida triggered a jump in New York orange juice prices on Wednesday, as they surged to a six-week high in early trading.

Florida produces more than 75 percent of the U.S. orange crop and accounts for about 40 percent of the world's orange juice supply, making it key to volatility in orange juice futures trading.

The Atlantic hurricane season runs from June 1 through November 30 and August has traditionally been an active month in the six-month period. Friday is the 20th anniversary of Hurricane Andrew, which caused widespread damage when it came barreling ashore south of Miami on August 24, 1992.

Lurking behind Isaac, the NHC said another tropical depression formed over the eastern tropical Atlantic on Wednesday, about 860 miles west-southwest of the Cape Verde Islands. It was packing winds of 35 mph and will take the name Joyce if it becomes a tropical storm.

FTC wins $478 million judgment against infomercial scammers

(Reuters) - A U.S. judge has issued a $478 million judgment against the marketers of a series of get-rich-quick real estate infomercials that the Federal Trade Commission said duped almost a million consumers with their claims.

The decision, announced by the FTC on Thursday, marked the largest litigated judgment ever obtained by the agency. It was part of one of several cases the agency has filed as part of its mission to deter scams targeting financial distressed consumers.

"This huge judgment serves notice to anyone thinking of using phony get-rich-quick schemes to defraud consumers," Jeffrey Klurfeld, director of the western region of the FTC, said in a statement.

The FTC filed the lawsuit in June 2009 against the marketers of the three "systems" for making money quick, including "John Beck's Free & Clear Real Estate System." The John Beck system promised to teach consumers how to buy homes for "pennies on the dollar" during government sales, according to the complaint.

But the FTC said the people behind that system and two others made false and unsubstantiated claims about how much money consumers could make using that system and others. Despite the marketing, nearly all buyers of the $39.95 products lost money, the FTC said.

U.S. District Judge Jacqueline Nguyen in Los Angeles, who entered the judgment Tuesday, also imposed a lifetime ban from infomercial production and telemarketing against three defendants including Douglas Gravink and Gary Hewitt, who founded Family Products LLC, the company behind the advertising.

Gravink and Hewitt, who are jointly and severably responsible for the monetary part of the judgment, will likely appeal the order to the extent it imposes a lifetime ban, said Larry Russ, a lawyer for the two at Russ August & Kabat.

"We just believe the evidence doesn't support that kind of a harsh and broad order," Russ said.

Lawyers for Beck, who is responsible for $113.3 million of the judgment alongside Gravink and Hewitt, declined comment.
