FTC wins $478 million judgment against infomercial scammers

(Reuters) - A U.S. judge has issued a $478 million judgment against the marketers of a series of get-rich-quick real estate infomercials that the Federal Trade Commission said duped almost a million consumers with their claims.

The decision, announced by the FTC on Thursday, marked the largest litigated judgment ever obtained by the agency. It was part of one of several cases the agency has filed as part of its mission to deter scams targeting financial distressed consumers.

"This huge judgment serves notice to anyone thinking of using phony get-rich-quick schemes to defraud consumers," Jeffrey Klurfeld, director of the western region of the FTC, said in a statement.

The FTC filed the lawsuit in June 2009 against the marketers of the three "systems" for making money quick, including "John Beck's Free & Clear Real Estate System." The John Beck system promised to teach consumers how to buy homes for "pennies on the dollar" during government sales, according to the complaint.

But the FTC said the people behind that system and two others made false and unsubstantiated claims about how much money consumers could make using that system and others. Despite the marketing, nearly all buyers of the $39.95 products lost money, the FTC said.

U.S. District Judge Jacqueline Nguyen in Los Angeles, who entered the judgment Tuesday, also imposed a lifetime ban from infomercial production and telemarketing against three defendants including Douglas Gravink and Gary Hewitt, who founded Family Products LLC, the company behind the advertising.

Gravink and Hewitt, who are jointly and severably responsible for the monetary part of the judgment, will likely appeal the order to the extent it imposes a lifetime ban, said Larry Russ, a lawyer for the two at Russ August & Kabat.

"We just believe the evidence doesn't support that kind of a harsh and broad order," Russ said.

Lawyers for Beck, who is responsible for $113.3 million of the judgment alongside Gravink and Hewitt, declined comment.

Organizational Description:
The University Controller/Accounting Services Office is dedicated to facilitating the primary mission of the University by seeking the most cost-effective methods of delivering services while continuing to implement improvement of services to students, faculty, staff and all other customers.

Overview:
Under general direction of the Student Financial Services Manager, the incumbent is responsible for reviewing and performing cashiering functions, performing various receptionist and general office duties; reviewing and analyzing student accounts; and performing various student accounting functions that include refunds, disbursements and other related duties as assigned.

Position Summary:
Responsibilities include, good friendly customer service skills, answer multiple phone lines, balance cash drawer daily, communicate effectively orally and written, create spreadsheets and reports using electronic spreadsheets, word processors and email, disburse payroll checks to students, faculty and staff, file, follow oral and written procedures, maintain a professional-like attitude at all times while on duty, maintain a safe and clean work environment, maintain regular attendance (when scheduled), make knowledgeable decisions on confidential matters relating to student accounts and payroll disbursement issues, monitoring lines when needed, must be eligible to qualify for a fidelity bond, operate a bulk currency scanner and other machinery, perform arithmetic calculations with speed and accuracy, perform reconciliations, prepare daily bank deposits, provide information to students, faculty and staff, receipt payments using a computerized receipting system, type, use a personal computer, work effectively with students, faculty, staff and the general public from diverse ethnic, cultural and socio-economic backgrounds, work independently and in a team environment, work overtime during peak periods, work under pressure with frequent interruptions and perform other related duties as may be required or directed.

Knowledge, Skills & Abilities:

• Some knowledge of general accounting principals
• Working knowledge of arithmetic and general office methods, practices and procedures
• Working knowledge of cash receipting functions and cash auditing procedures
• Must possess typing/data entry skills sufficient to perform the duties of the position
• Must possess friendly, courteous customer service skills

Ability to:

• Communicate effectively orally and in writing
• Create spreadsheets and reports using Excel, word processors and email
• Perform cashiering and accounting reconciliation

Education and Experience:

• One year of experience in cashiering work, with general office work

Specialized Skills:

• Must be eligible to qualify for a fidelity bond
• Knowledge of PeopleSoft and/or CASHNet
• Knowledge of standard office systems and proficient in the use Microsoft Office (Word, Excel and PowerPoint)

Preferred Skills:
One year of recent accounting experience demonstrating general knowledge of basic accounting principles.

Google's Project Glass gets some more details

Google's Project Glass has been one of the most anticipated and hyped projects to come out of Google in quite some time. After a rather epic demo the company finally gave us a slightly deeper look at the wearable computer of our (supposed) future. Inside is the usual set of components you'd expect inside any mobile phone. There's a "powerful" CPU and "lots" of RAM (though, there was no mention of specifics) alongside an accelerometer, gyroscope and wireless radios for pulling in data. There's a mic for voice commands, a speaker and a camera, which can also be controlled by the touchpad that lines the side of the wearable device. All of those components sit off to one side, though Google says they're still well balanced and actually lighter than some pairs of sunglasses. The tiny transparent display doesn't actually sit directly in front of your eye. It's slightly above your line of vision, so that it shouldn't interfere with your normal life.

Sergey Brin had three different prototypes on stage -- a light blue pair, a white pair and a black pair -- indicating that personalization and style were a concern. And that's a good thing since Glass is meant to be worn in public. Ultimately Google hopes that the project will be the next step in its quest to make information quickly and universally accessible. The ability to capture images from the first person perspective seems to be key to the device. In a new demo video, a new mother waxes about how hard it is to capture those perfect moments with her child. She "smiles at faces not devices" which makes sticking a D5 in the baby's face a bad idea.

If you're impatient and lucky enough to have been at IO (and live in the US), you can actually pre-order an Explorer Edition of the wearable computer for $1,500. The dev focused units will be shipping early next year. But, be warned, this is not a mass consumer item and will likely be more than a little rough around the edges.

'Catching Fire': Wait, Is Romeo Joining The Cast?!

Romeo Miller tells MTV News he's already met with Lionsgate about possibly appearing in one of the 'Hunger Games' flicks.

Romeo Miller (formerly known as Lil' Romeo) has racked up an impressive number of credits in the decade or so that he's been acting. As the 22-year-old makes moves in his career as an adult actor, Romeo has his eyes set on one franchise in particular.

One of Miller's ideal projects would be a trip to Panem for "The Hunger Games," he told MTV News during a recent interview for "Madea's Witness Protection." In fact, he's already met with Lionsgate to discuss the possibility.

Although he got his start as the rap star son of Master P, Miller has been acting for years now. "A lot of people don't know I've been doing this for 10 years now," he said. "I felt that all of that was practice, leading up to the time now."

But for his next roles, Miller has his sights set on an acting career similar to Will Smith. "I want to be the next big action hero or I want to do a lot of romantic type movies, romantic comedies, a little bit of everything, but definitely the next action hero," Miller said, and then added, "You can see me in 'The Hunger Games' or something like that. Just throwing that out there."

Though he admitted to not being very familiar with Suzanne Collins' books, Miller confirmed that there has been some discussion about possibly joining "Catching Fire," which is currently casting.

"I actually just met with Lionsgate about that, so you may be seeing me in one of the 'Hunger Games.' That's all I'm saying," Miller said. "Not a particular role, we just had a meeting, seeing if it was something I was interested in. I can't really talk too much, or they'll kill me. You know how 'The Hunger Games' is."
